By actively associating Chainy Collection on User Generated Content you grant Chainy Collection the worldwide, perpetual, irrevocable, royalty-free, fully-paid, non-exclusive, transferable right to use your uploaded User Generated Content in any manner to be determined by our sole discretion, including but not limited to our webpages, social media pages operated by us, promotional e-mails and advertisements, and in other marketing, promotional and advertising initiatives, in any media now or hereafter known.
By actively associating Chainy Collection on your User Generated Content you hereby represent and warrant that (1) you own all rights in and to your User Generated Content, (2) if the User Generated Content is subject to third party proprietary rights, you have all necessary licenses, rights, consents, and permissions to publish the User Generated Content you publish and to grant the rights granted herein, including permission from all person(s) appearing in your User Content; (3) you and other people in your User Generated Content are not minor(s), (4) you are legally entitled to post the User Generated Content, and the use of your User Generated Content as described herein will not violate the rights, including but not limited to copyright, trademark, privacy, publicity or other proprietary rights, of any third party or any law, and (5) the User Generated Content is not libellous, defamatory, obscene, pornographic, abusive, indecent, threatening, harassing, hateful, or offensive. You hereby release, discharge and agree to hold Chainy Collection, and any person acting on their behalf, harmless from any liability related in any way to our use of your User Generated Content.
The User Generated Content that you publish is deemed non-confidential and we have no obligation to maintain the confidentiality of any information, in whatever form, contained in any submission, except pursuant to our respective privacy policies. By using the Services, you are consenting to Chainy Collection collecting any personal information you provide for our use and disclosure in connection with the use of your User Generated Content as described herein. If you do not agree to the collection, use and disclosure of your personal information in this way, please do not use the Services or otherwise provide us with personal information by contacting info@chainycollection.com. Your personal information may be transferred to servers located outside the country in which you live or to affiliates or other trusted third parties based in other countries so that they may process personal information on our behalf. Chainy Collection reserves the right to remove any User Generated Content from the Site, the Brand properties and the Services at any time, for any reason. We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.
SECTION 4 – SHOPIFY
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.
Payment: If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.
